Kripa Upadhyay
Kripa is a partner at Buchalter, P.C. Kripa’s practice specializes in the intersection of immigration law, employment law, and corporate/business law. She routinely advises and represents business owners in I-9 audits before the Homeland Security Investigations (HSI) and the Office of Chief Administrative Officer (OCAHO) defending business owners in I-9 compliance investigations. She also routinely advises HR and business leaders on the immigration-related consequences of onboarding and terminating foreign national employees. This includes developing immigration strategies for companies that frequently onboard or transfer employees from jurisdictions outside the U.S. She regularly counsels corporate clients on compliance with Immigration and Department of Labor regulations regarding the employment of foreign nationals in the United States. Additionally, Ms. Upadhyay assists in developing Standard Operating Procedures (SOPs) to ensure corporations maintain compliance with relevant immigration and labor laws.

Meredith Doll is Of Counsel in Buchalter's Dallas office and a member of the Immigration practice group. As a dedicated employment-based immigration attorney, Ms. Doll advises clients on all facets of business immigration compliance, from sponsoring foreign-born employees to I-9 audits. Her public sector clients include universities, hospitals, and healthcare systems, including medical schools, faculty physician groups, and individual faculty, researchers and medical providers. Her private sector clients range from early-stage start-ups to established multinationals in the financial services, healthcare, heavy industry, industrial manufacturing, medical technology and life sciences sectors.

About the Webinar
This presentation is for attorneys who wish to learn how to protect small businesses and nonprofits from one aspect of the federal government's crackdown against immigrants. If a small business or nonprofit has employees, they are required to maintain proper Form I-9 records, which are not filed with the government but rather are subject to audit. The federal government has been aggressively auditing organizations and imposing the maximum penalties allowed by law even for minor mistakes. There are also reports of small businesses that have been targeted with an I-9 audit immediately after speaking out against the government's actions in Minneapolis. As a result, Communities Rise is seeking volunteer attorneys who are willing to advise clients on Form I-9 compliance issues before an audit comes. This session is intended for attorneys who have no experience advising clients on Form I-9 issues. Form I-9 is the instrument by which employers document their compliance with federal immigration laws (IRCA/INA), which restrict who may be lawfully employed in the United States. Even if an organization only hires individuals who are legally permitted to be employed in the United States, an organization may still face steep penalties if a government-initiated audit uncovers problems with their Form I-9 records. This CLE will cover: identity and work eligibility verification requirements, recognizing common technical and substantive errors in documentation, preparing for federal government audits and potential ICE enforcement actions, and additional educational resources.
